1. About Kaamwale

Kaamwale ("we", "us", or "our") operates an online listing and discovery platform that helps employers find blue-collar and daily-wage workers, and helps workers be discovered by nearby employers based on skills, pincode, and availability.

Kaamwale is not an employer, labour contractor, placement agency, or agent for any user. We do not hire workers, assign jobs, supervise work, or guarantee employment. All work arrangements are made directly between workers and employers.

2. Eligibility

You must be at least 18 years of age and legally capable of entering into binding contracts under Indian law to use the Platform.

By using the Platform, you represent that the information you provide is accurate and that you will use the Platform only for lawful purposes related to finding or offering daily, part-time, or short-term work.

3. Accounts and verification

Access to certain features requires registration using a valid Indian mobile number and one-time password (OTP) verification. You agree to:

• Provide accurate registration and profile information and keep it up to date.
• Maintain the confidentiality of access to your account and not share OTPs or login sessions with others.
• Notify us promptly if you suspect unauthorised use of your account.
• Accept that we may limit OTP requests, suspend accounts, or require re-verification to protect the Platform and users.

4. Platform role

Kaamwale provides technology to list, search, and view worker profiles. We do not:

• Employ, pay wages to, or control workers listed on the Platform.
• Guarantee the identity, skill level, background, availability, or conduct of any user.
• Negotiate, collect, or disburse wages or payments between users.
• Provide insurance, safety equipment, or workplace compliance for any job.
• Mediate or resolve disputes arising from work performed or not performed.

5. Worker listings

Workers may create a public profile including name, skills, service pincodes, availability, photo, and contact details visible to registered employers as designed on the Platform.

Workers are solely responsible for the accuracy of their profile, updating availability, responding to inquiries, and deciding whether to accept any work. Listing on Kaamwale does not guarantee job offers or income.

6. Employer responsibilities

Employers using the Platform agree to:

• Verify a worker's identity, skills, references, and suitability before hiring.
• Comply with applicable labour laws, minimum wage rules, working hours, safety standards, and tax obligations.
• Agree wages, scope of work, duration, and payment terms directly with the worker in good faith.
• Treat workers with dignity and not use the Platform for harassment, discrimination, illegal work, or exploitation.

7. Payments and wages

All payments for work are arranged directly between the worker and employer. Kaamwale does not process wages, hold funds, or act as a payment intermediary unless we explicitly introduce a separate paid feature and disclose its terms.

Any optional paid features on the Platform (such as credits or premium visibility, if offered) will be subject to additional pricing terms shown at the time of purchase. Fees paid to Kaamwale are for Platform services only and do not constitute wages.

8. Location and search

The Platform may use pincode entry, browser location, or third-party geocoding services to improve search results. Location data is used as described in our Privacy Policy.

Search results are provided for convenience and may not be complete or real-time. Availability status shown on profiles is self-reported by workers and is not guaranteed by Kaamwale.

9. Prohibited conduct

You must not use the Platform to:

• Post false, misleading, or impersonated profiles or reviews.
• Harass, threaten, abuse, or discriminate against any person.
• Solicit or engage in illegal activities, child labour, bonded labour, or unsafe work.
• Scrape, copy, or resell Platform data without our written permission.
• Upload malware, interfere with security, or overload our systems.
• Circumvent access controls, OTP limits, or account restrictions.
• Use contact details obtained through the Platform for spam or unrelated marketing.
• Violate any applicable law or third-party rights.

10. Content and intellectual property

You retain ownership of content you submit (such as photos and profile text) but grant Kaamwale a non-exclusive, royalty-free licence to host, display, and use that content solely to operate and promote the Platform.

The Kaamwale name, logo, software, and site design are our property or our licensors' property. You may not copy or use them without permission except as allowed by normal use of the Platform.

11. Suspension and termination

We may suspend or terminate your access, remove listings, or restrict features if we reasonably believe you have:

• Breached these Terms or applicable law.
• Created risk or harm to other users or to Kaamwale.
• Provided inaccurate or fraudulent information.
• Misused the Platform in any way described in Section 9.

12. Disclaimer

The Platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Kaamwale disclaims all warranties, express or implied, including fitness for a particular purpose and non-infringement.

We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components, or that any user is trustworthy or qualified for any task.

13. Limitation of liability

To the maximum extent permitted by applicable law, Kaamwale and its operators, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or personal injury arising from your use of the Platform or any work arranged through it.

Our total liability for any claim relating to the Platform shall not exceed the greater of (a) the amount you paid to Kaamwale in the twelve months before the claim, or (b) one thousand Indian rupees (₹1,000), except where liability cannot be limited under applicable law.

14. Indemnity

You agree to indemnify and hold harmless Kaamwale from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Platform, your profile content, your interactions with other users, or your breach of these Terms.

This indemnity does not apply to the extent a claim arises from our gross negligence or wilful misconduct.

15. Changes to Terms

We may update these Terms from time to time. The "Last updated" date at the top will change when we do. Material changes may be communicated through the Platform or by other reasonable means.

Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Platform and may request account deletion by contacting us.

16. Governing law and contact

These Terms are governed by the laws of India. Courts in India shall have exclusive jurisdiction over disputes arising from these Terms, subject to any mandatory consumer protection provisions that apply to you. Questions may be sent via our Contact page or to support@kaamwale.com.
